1. Price and Payment
The price of each product is the one indicated on the Website for the corresponding product, except in the case of an obvious error. Prices include VAT at the applicable rate in force at the time. Any change in the applicable VAT rate may be reflected in the price of the products. Prices are subject to change at any time. However, the applicable prices are those in effect at the date and time you validate your order on the Website.
Any delivery charges are not included in the product prices displayed on the Website, unless otherwise stated. The amount of the delivery charges, if applicable, will be shown separately before you confirm your order and will be added to the price of the selected products to constitute the total order amount. The unit prices of the ordered products and any applicable delivery fees will again be specified in the order confirmation email, as will the total price. You agree that HAMILTON is not obliged to deliver a product at an incorrect price if the pricing error is obvious and could reasonably have been recognized by you as such. In such a case, HAMILTON will contact you to correct the error and request payment of the correct amount before delivery, subject to your right to cancel the portion of the order related to the erroneously priced product.
Payment may be made using the credit cards described during the Website's ordering process, including credit card (Visa or Mastercard), PayPal, and Klarna.
HAMILTON will confirm the total amount due in the order confirmation email. In all cases, the submission of your credit card number and final order confirmation shall constitute proof of the entire order in accordance with Article XII.15 of the Belgian Code of Economic Law and Article 1322 of the Civil Code, and shall imply the enforceability of the amounts due by virtue of the products listed on the order summary.
HAMILTON will debit your bank account just before delivery and will inform you that products will only be delivered once full payment has been received. HAMILTON therefore reserves the right to postpone delivery until full payment has been made, without incurring liability for late or failed delivery.
All credit card payments are subject to validation checks by the card issuer, who must authorize payment of the full order amount. The cardholder’s personal data that is strictly necessary for such checks may be shared with third parties. If the card issuer does not authorize payment, HAMILTON cannot be held responsible for delayed or non-delivery. Furthermore, in such cases, HAMILTON reserves the right to terminate the contract with immediate effect by written notice.
The Recupel fee is included in the price of electronic devices.
 
2. Delivery
HAMILTON will inform you of the delivery date of your order via a shipping notification email sent to your email address.
The delivery address will correspond to the information you provided and that HAMILTON confirmed in the order confirmation email. If you are not present at the time of delivery, a delivery notice will be left and you will be responsible for collecting the package at the location and within the time limits specified. If the deadline is missed, the products will be returned to HAMILTON, and it will be your responsibility to contact HAMILTON’s customer service to arrange a possible reshipment at your expense.
HAMILTON only delivers within Belgium. If you reside outside of this country and wish to arrange international delivery, please visit https://www.hamiltonwatch.com.
For practical reasons, certain products from the same order may be shipped separately (split shipment). If this occurs, it will be stated in the shipping notice, and you will not be charged additional delivery fees.
If HAMILTON cannot meet the delivery deadline specified in the order confirmation email, and you are not at fault (e.g., by failing to pay), HAMILTON will immediately contact you to provide a new delivery date. If you reject the new delivery date or, in any case, fourteen (14) days after the initial delivery deadline, you may cancel the order by sending a registered letter with acknowledgment of receipt or an email to the address listed in Article 1 of these Terms of Sale. In this case, any amounts paid for the affected products, including delivery charges, will be refunded within fourteen (14) days by crediting the account linked to the credit/debit card used for the order.
 
3. Transfer of Risk and Ownership
A product ordered on the Website becomes your property once full payment of the purchase price (including delivery charges) has been made.
Risk transfers to you upon delivery. “Risk” in this context includes damage to the product or risks arising from its use, handling, or storage. You assume the risks related to returning a product for any reason.
 
4. Right of Withdrawal and Product Returns
You have the right to inform HAMILTON that you are cancelling your purchase, without penalties and without providing reasons, within fourteen (14) calendar days from the day the product is delivered, or from the day the last product is delivered in the case of split shipments.
To exercise your right of withdrawal, you must:

Inform us of your decision to return the product(s) by means of an unambiguous statement sent by email to shopbe@hamiltonwatch.com. You may, but are not obliged to, use the legal withdrawal form available [here]. Please include your order number as shown on your invoice.
Return the product to The Swatch Group (Belgium) SA, HAMILTON eCommerce, 1424 Chaussée de Mons, B-1070 Brussels, in its original packaging and with the delivery slip, within fourteen (14) days following your notification of withdrawal.
However, some products are excluded from this right, including earrings (for hygiene reasons) and personalized items. The right of withdrawal cannot be exercised for goods made to the consumer's specifications or clearly personalized. As such, HAMILTON does not accept returns or refunds for engraved products.
2. If the withdrawal is made within the time frame and conditions outlined above and the returned product has not been worn or used, is undamaged, and is in its original packaging (including extra links, warranty card, and manual intact), HAMILTON will refund the invoiced price. Return shipping costs are your responsibility and will not be reimbursed.
3. HAMILTON offers the possibility to exchange your product. This option follows the same procedure, conditions, and restrictions as a withdrawal. You must explicitly state in your email that you wish to exchange the product. Return shipping costs remain your responsibility.
4. Any product returned incomplete, damaged, used, or soiled will not be accepted for refund or exchange.
5. If you returned one or more product(s) under your right of withdrawal and wish to be refunded, HAMILTON will reimburse the invoiced amount, including any delivery fees (where applicable), within fourteen (14) days of receiving notice of your withdrawal, unless the product(s) have not yet been received. In that case, reimbursement will occur within fourteen (14) days of receipt of the returned product(s). Refunds will be made to the account used for the original purchase.
6. Only new, unworn products accompanied by their warranty card and in their original packaging may be returned. Products with a broken seal will not be accepted. The right of withdrawal does not apply to custom-made or clearly personalized products, nor to services that have already been fully performed or to the delivery of digital content already executed.

5. Warranty

Contractual Warranty:
If the product is damaged or has a defect, HAMILTON will, after assessment, either immediately repair the product or deliver a replacement product upon receipt by The Swatch Group (Belgium) SA / HAMILTON E-COMMERCE, Chaussée de Mons 1424, B-1070 Brussels of the damaged or defective product.
All watches offered for sale on this Website come with a 24-month international warranty issued by Hamilton International Ltd, Bienne, Switzerland, for material or manufacturing defects existing at the time of delivery of the purchased HAMILTON watch. The general terms and conditions of the warranty are provided in the International Warranty booklet supplied with each watch.
Warranty claims must be made through an authorized HAMILTON retailer or by returning the product to The Swatch Group (Belgium) SA / HAMILTON E-COMMERCE, Chaussée de Mons 1424, B-1070 Brussels.
Any claim under the warranty must be accompanied by one of the following documents:

an international warranty certificate with stamp, date, and product reference
the original invoice or original delivery note along with a bank or credit card statement.
Statutory Warranty:
The seller is obliged to deliver goods that conform to the contract and is liable for any lack of conformity existing at the time of delivery (Article 1604, §1 of the Civil Code). This includes any lack of conformity arising from packaging, assembly instructions, or installation if these were the seller’s responsibility under the contract or performed under their responsibility.
To be deemed conforming to the contract, the product must:

1° Be fit for the usual purpose of a similar product and, where applicable:

match the description provided by the seller and possess the qualities presented to the buyer in the form of a sample or model;
possess the features mutually agreed upon by the parties or be suitable for any special use made known to the seller and accepted by them;
be suitable for the purpose usually associated with such goods;
possess the quality and performance that a consumer can reasonably expect of goods of the same type, considering the nature of the product and any public statements made about specific characteristics of the product by the seller, producer, or their representative (except in the cases described in Article 1649ter, §2 of the Civil Code), notably in advertising or labeling (Article 1649ter, §1 of the Civil Code).
The seller is liable to the consumer for any lack of conformity that exists at the time of delivery and appears within two years from that time (Article 1649quater, §1, al. 1, of the Civil Code).
Any legal action due to non-conformity must be initiated within one year from the day the defect is discovered, without exceeding the two-year period mentioned in Article 1649quater, §1 of the Civil Code (Article 1649quater, §3 of the Civil Code).
Pursuant to Article 1649quater, §2 of the Civil Code, you agree to notify HAMILTON of any lack of conformity within two (2) months from the date you discovered the defect.
The seller is also liable for hidden defects of the product sold that make it unfit for its intended use, or that diminish such use to the extent that the buyer would not have acquired it or would have paid a lower price had they known of the defect (Article 1641 of the Civil Code).
The action resulting from latent defects must be brought by the buyer within a short time, depending on the nature of the defect and the usage in the location where the sale took place (Article 1648 of the Civil Code).
Any claim under the statutory warranty must be accompanied by the original invoice or delivery note, along with a bank or credit card statement showing proof of payment for the product concerned.
If you are entitled to the statutory warranty, you may choose between repair or replacement, unless your choice is impossible or would incur disproportionate costs for HAMILTON. If repair or replacement is both impossible or disproportionate, or cannot be carried out within a reasonable time or without major inconvenience, you are entitled to a price reduction or may request termination of the contract.
Return shipping costs will be reimbursed if the products returned to HAMILTON within the stated timeframes do not correspond to those you ordered or are defective or affected by a hidden defect. If you are reimbursed for one or more HAMILTON products under the above statutory warranty, HAMILTON will refund the invoiced amount for the returned product(s), including shipping costs, within fourteen (14) days of receipt of the relevant product(s).
6. Liability

HAMILTON is responsible for the proper performance of contractual obligations, whether these are fulfilled by HAMILTON itself or by service providers engaged by it in connection with these Terms of Sale, subject to any rights of recourse against those parties.
However, HAMILTON is not liable for damages caused by your own actions, omissions, or fault, in the case of force majeure, or by any third party not affiliated with HAMILTON in the execution of the contract.
HAMILTON exercises the utmost care in presenting and describing its products on the Website. However, the photos of the products are provided on the Website for illustrative purposes only. Please refer to the product description on the Website for precise characteristics.
Browsing and placing orders on the Website implies knowledge and acceptance of the characteristics and limitations of the Internet, especially concerning technical performance, response times for consulting, querying, or transferring information, the risk of interruption, and more generally, the risks inherent in any connection to and transmission via the Internet, the lack of protection of certain data against potential misuse, and the risk of contamination by viruses circulating on the network.
HAMILTON cannot be held liable for any direct or indirect damage resulting from an interruption or malfunction of any kind, for any reason, or for any direct or indirect damage resulting in any way from a connection to the Website. It is the responsibility of each internet user to take all appropriate measures to protect their own data and/or software stored on their computer equipment against harm. Connecting to the Website is entirely at the user’s own risk.
In any event, except in the case of willful misconduct, gross negligence, or liability for defective products, HAMILTON's liability for all damages it may cause you that are compensable under the contract is limited solely to the repair of foreseeable, direct, and material damages actually suffered by you due to HAMILTON’s breach. This compensation shall not exceed the purchase price of the product that caused the damage, even if HAMILTON was informed of the possibility of such damage.

7. Ownership Rights and Authorization of Use

HAMILTON, other Swatch Group companies, and/or third-party companies hold intellectual or industrial property rights (e.g., copyright, trademark rights, patent rights, registered design rights, etc.) over all information, software, documentation, data, structures and databases, services, logos, brands, designs, texts, video files, audio files, images, and other content (hereinafter referred to as “Content”) published on or used in connection with the Website. The absence of a property rights notice does not imply that the elements on the Website are not protected by rights held by HAMILTON, other Swatch Group companies, or third-party companies.
The Content of the Website may only be downloaded, displayed, and/or printed for private and non-commercial purposes, and only provided that, to the extent and as long as:

The documents or associated graphics on the Website are not modified, disassembled, or translated;
The graphics on the Website are not used without the accompanying texts;
All copyright or other proprietary notices linked to the content downloaded by the user are retained and reproduced;
The source code or structure of representations and/or content and/or the content itself is not disclosed, decompiled, or used for purposes other than those strictly necessary for the operation and use of the Website; and/or
The content is not used for the manufacture of derivative products.
Total or partial reproduction of the Website is strictly prohibited.
You are strictly prohibited from disclosing, altering, transferring, reusing, or using the Website’s Content for public purposes without HAMILTON’s prior written consent. You are solely responsible for any use or manipulation of the information or materials on the Website. If you fail to comply with the Terms of Use, your access to the Website may be revoked, and, if applicable, you will be required to immediately destroy all information downloaded or printed from the Website. HAMILTON reserves the right to fully enforce its rights concerning the Website Content, including intellectual property rights, and to take legal action if deemed necessary.
Article 10.2 above in no way authorizes the reproduction or storage of all or part of the Website on another site or its inclusion in a public or private database without HAMILTON’s prior written consent.
8. Links to and from Other Websites

Hyperlinks from the Website to third-party websites may exist. These sites are not under HAMILTON’s control, and you acknowledge that HAMILTON is not responsible for the accuracy, legality, or content of these websites, nor for their respect of intellectual or industrial property rights. HAMILTON cannot reasonably be expected to conduct continuous monitoring of linked websites without a concrete indication of rights violations. HAMILTON will immediately remove such links if it becomes aware of any rights violations. HAMILTON cannot guarantee that you will be satisfied with the products or services obtained through such third-party sites. You are advised to carry out any necessary or appropriate investigations before making any transactions with these third-party websites.
Using links to the Website, to other external pages, or to other websites is at your own risk. By using these links, you understand that the terms of use, legal notices, and privacy policies of the linked site will apply and may differ from those of HAMILTON.
Creating hyperlinks to the HAMILTON Website is permitted only for private and non-commercial purposes and only if:

No deep linking or hotlinking is created;
The HAMILTON logo or trademarks are not removed or altered;
It is not suggested that HAMILTON endorses or supports a third-party product or service;
Your relationship with HAMILTON is not misrepresented, and false information is not disclosed about HAMILTON or information that could damage HAMILTON’s reputation and trademarks;
No other HAMILTON trademarks are used on your website without prior written consent from HAMILTON; and

9. Duration

These Terms of Sale apply throughout the time that products offered by HAMILTON are available for sale on the Website. They are subject to amendments and/or revisions. The applicable conditions are those in effect at the time you confirm your order, unless subsequent changes or revisions to the Terms of Sale are required by changes in applicable legislation or by public authorities. The Terms of Sale accepted by you will be included in the email confirming your order.
10. Miscellaneous

Transfer of rights and obligations. The contract established between HAMILTON and you is binding upon and ensures to the benefit of HAMILTON, yourself, and our respective successors and assigns. You may not transfer, assign, charge, or otherwise dispose of your right to receive delivery of the products described in this contract without our prior written consent. You authorize HAMILTON to outsource one or more of its rights or obligations under the contract to a third party, including, but not limited to, affiliates of The Swatch Group (Belgium) SA.
Validity. If any provision of these Terms of Sale is deemed illegal or unenforceable by a court ruling, the remaining provisions will remain valid and applicable.
Electronic communication. By browsing our Website, you agree that communications—in accordance with applicable law—may be made electronically. The computerized records maintained in the IT systems of HAMILTON and its service providers under reasonable security conditions shall be considered as proof of orders, communications, and payments between HAMILTON and you. The archiving of order confirmations and invoices is done on a reliable and durable medium to constitute sufficient written evidence as per Article 1347 of the Civil Code.

Jurisdiction and applicable law. These Terms of Sale and the contract between HAMILTON and you regarding the purchase of products via the Website are governed by Belgian law. The competent court shall be the court of your place of residence as determined by applicable internal laws.
The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply.
The information you provide in connection with your order, such as messages for gift cards, personalization texts/photos (e.g., engraving), or photos of your watch and its movement, may be refused without justification. In such cases, we reserve the right to cancel your contract and issue a refund or cancel your order, as applicable. We accept no liability for the accuracy or appropriateness of such information.
